My career began with a case that would conclude after a two-year federal trial in the acquittal of 20 alleged members of the “Lucchese Family.” This case was so notorious, it inspired the movie “Find Me Guilty” and the books “The Boys From New Jersey” (hardcover) and “Mafia Wiseguys” (paperback).
Other notable cases include the reversed murder conviction of Lawrence Simmons after Mr. Simons unjustly spent 23 years in prison. I write to your office in the most unlikely of circumstances than any and all of my previous letters. After much unreasonable delays and reappointment after reappointment of attorneys, I was eventually appointed Mr. John Saykanic. As I am a religious person I have to say that happen previously was to set me up for the best!!
Mr. John Saykanic, is the best criminal attorney I have encounter in all my years of being arrested, and I venture to say that your office works with. While I don’t know every attorney whom you actually employ, I will say taht from my own experiene and the stories I’ve personally heard I stand by this. He is that not because he know it all or because he is perfect or does any and everything that the client my want and ask. Simply Put he goes by the Ruels of Professional Conduct and he listens, reviews and investigates, communicates his findings and support as needed in making most decisions. That is why I write this letter and why I write it where I’m from. Had this been done sooner by any of the attorneys I was appointed per trial by your agency or that I paid it is highly improbable I would even be here. In spite of all that he has done in moving my case forward I’m under the impression he is being given a hard time receving full and proper compensation for what he has done and continues to do. This is absurd!!
He is a lawyer that if more lawyer were like him the profession wouldn’t look so bad. I’m not saying we agreed on everything or I got all that I wanted as I wanted. What I am saying is I got what is guaranteed by Constitution, In effective representation. He should be commended and appeased, this case was no easy ask, and the reading and actual work requied to present the matters comprising the record and leglities of the legal arguments present and relevant were tedious and numerous. Had he not listened, effectively communicated and after speaking with me did his own independent research, the most significant evidence central to my fight that the appellate section failed to obtain in well over 6 months, would have almost surely been lost.
You know why that is almost indisputably a fact? Because 99% of appellate attorneys, upon receving your case files for an appeal form the OPD office, will normally contact you and subsequently tell you: “I am the attorney appointed as your attorney and I’ve yet to review your case file. I will be reviewing your file(s) and transcript(s) in the coming weeks and days upon the conclusion of my current case load. After my careful review of same I will decide what legal issues and avenues are available and began perparing your legal brief. This may take a few weeks. In the mean time if you have questions or things you would like me to know please feel free to contact me at this address or number. As I am normally in court or working I may not be able to take your call, yet I will respond to you message and inquires. Once I am finish I will submit my brief to the public Defender’s office and they will file and then send you a copy of the transcripts comprising the record for appeal and copy of the corresponding brief containing your legal merit brief for your records and review“.
That or some variation of same is general letter attorneys send, yet without at least the option or chance of review in advance of the legal arguments and provided transcripts retrieved by public defender’s office, I nor any defendant has the chance to infrom his attorney of some document that althought relevant is missing yet pertinent to their appeals. Mr. Saykanic, for his communication, review of the records and professionalism has distinguished himself in his respective feild, and should be commended and championed, not disrespected or undervalued over his fees. The service of a good lawyer, doctor or public service person is priceless simply because they serve to protect and save human life. If he sees the merit and legal validity, why is he or me for that matter being held up or delayed in filing documents to the same effect? There Counsel concerning the wirestap suppression we didn’t. for strategic reason.
In closing I ask that your policy of not normally asking or giving a appellant the chance to review transcripts be reviewed and changes. I ask that his request be granted concerning futhering my legal matters without any further delay. Lastly, I’m asking that you value Mr. Saykanic and retain more like him otherwise you will be doing yourself and the public a MAJOR DISSERVICE!! No matter the outcome of my appeal I’m convienced he gave me the best chance for justice and that I will prevail.
